Alanis Bill Would Repeal California Proposition 47

Sacramento – Vice Chairman of the Assembly Public Safety Committee, Assemblyman Juan Alanis introduced a legislative proposal (AB 335) to repeal Proposition 47. Alanis also announced his work on eleven other public safety proposals.

“Public Safety is clearly broken in California,” said Juan Alanis. “Prop 47 is a failed experiment which has only catered to the criminals in our state. Fentanyl plagues our communities, schools, and society. We must attack our states crime problem as its source.”

AB 335 would repeal Proposition 47 in its entirety, with the exception of some cannabis-related language.

“Even if a Majority decides to block this legislation, we must have an honest conversation about providing real public safety solutions for California,” added Assemblymember Alanis. “I stand ready to work with my colleagues in both houses and across the aisle to make our justice system more fair, our state more safe and our communities better protected against the scourge of fentanyl.”

In addition to Assembly Bill 335, Assemblymember Alanis has introduced AB 243, Address Confidentially for Child Abduction Victims, and AB 225 – priority registration for peace officers. He will also introduce legislation to help law enforcement better police street racing, and streamline POST standards for law enforcement recruits in California.

Alanis is also co-authoring the following Public Safety Legislatino: AB 18 – Fentanyl Voluntary Manslaughter Advisory, AB 19 – Naloxone Hydrochloride for Opiods in schools. He is also working to co-author at least seven more legislative proposals on Public Safety yet to be introduced.

Two Additional Bills Take Swipe at Prop 47

AB 23 was introduced by Assemblymember Al Muratsuchi (D-Torrance) seeks to amend Proposition 47 and reduce the threshold amount for petty theft and shoplifting from $950 to $400.

This comes after many local businesses across the state are highlighting product loss, repeat shoplifting crimes, and many businesses have shuttered their doors–you also have viral videos. Many police departments are also highlighting repeat offenders in terms of serial shoplifters and package thieves.

With AB 23, on January 10, the Brentwood City Council agreed to write a letter of support for Assembly Bill 23, a petty theft bill, once either the Brentwood Police Department or California League of Cities takes a position.

On December 5, California State Republicans announced in their “California Promise” they would also be addressing Prop 47 and would seek to Restore Pre-Prop 47 Felonies.

The bill, which was to be introduced Assemblymembers Josh Hoover and Laurie Davies has not yet been introduced. They said in their release that they are seeking to increase penalties for serial theft crimes: Reenact the penalties which existed for the crime of committing petty theft with multiple prior theft-related convictions which existed prior to their repeal by Proposition 47 of 2014.
