District Attorney Dismisses Charges in Antioch Mutilation Case

by CC News
Antioch

The Contra Costa County District Attorney’s Office announced it has dismissed arson and mutilation charges against two men in the death of 25-year-old Mykaella Sharlman. Her remains were located burned along a trail in the City of Antioch.

The District Attorney’s office said it didn’t have confidence based on the investigative work done by Antioch Police officers who were associated with the racist text communications and said it didn’t have confidence in the integrity of the case.

On October 17, 2022, Antioch Police responded to a trail where they located a females body who was burned and mutilated. Police asked the public to help identify the woman prior to dental records revealing the woman’s identity as Sharlman.

By October 24, Antioch Police arrested two men and by October 26, the District Attorney’s office announced 32-year-old Ashton Montalvo and 39-year-old Deangelo Laraye Boone both face a two-count felony complaint for arson and mutilation. Montalvo has two special allegations due to a prior conviction for first degree residential burglary.

Statement on the Dismissal of People vs. Montalvo and Boone

Martinez, California – On June 6th 2023, the Contra Costa District Attorney’s Office determined the prosecution of The People of the State of California vs Ashton Montalvo and Deangelo Boone could not proceed to trial and moved to dismiss the case.

A dismissal at this juncture affords the District Attorney’s Office the ability to refile criminal charges against Montalvo and Boone and reinitiate legal action if new evidence is developed.

In this case, the prosecution of Montalvo and Boone for mutilation of human remains and arson on October 17, 2022, relied heavily on the investigative work of Antioch Police Officers who are associated with racist text communications.

After thoroughly reviewing the officers’ role in this case, applying relevant legal principles, and considering ethical responsibilities, the Contra Costa District Attorney’s Office no longer has confidence in the integrity of this prosecution.

Our office extends our deepest sympathies to the family of Mykaella Sharlman and we aspire to renew this prosecution if presented with the opportunity to do so.

Case No. 04-22-01085 | The People of the State of California vs. Boone, Deangelo Laraye

No other information was released by the District Attorney’s Office

Editors Note – rather than allowing a jury to determine if any evidence, video, testimony, or whether the Antioch Police text messages had an impact of the case, the District Attorney is simply walking away from it and not allowing a jury to determine guilt or innocence.

Antioch Police Seek Help Identifying Homicide Victim Found on Mokelumne Trail

The Antioch Police Department is seeking the public’s assistance to identify the female victim who was located on October 18, 2022 on the Mokelumne Trail in the City of Antioch.

According to police, the female victim located on the Mokelumne Trail between Gentrytown Drive and Lucena Way. Unfortunately, due to the severity of her sustained burns, we are having difficulty
identifying her.

The victim is believed to be of African American descent and is thought to be under 30 years old. Additionally, the victim is approximately 5’6″, and her weight is unknown. At the time of her discovery, she was wearing a ring on her right ring finger, as depicted in the attached photos, and a metal necklace with a pendant with the letter “K” attached.

While the “K” was the only letter connected to the chain, it is possible there were previously more letters.

Moreover, the victim had extensive dental work done in the past, including three missing left lower molars and a distinctive gap between her top front middle teeth. After the autopsy, investigators learned that the victim was deceased before being discovered by Con Fire.

Shaking my head. Anyone who is capable of committing this kind of evil, atrocious act should not be free. No consequences, no change in behavior.
