At its September 3 meeting, the Brentwood Planning Commission will look to discuss municipal code amendments to Temporary Use Permits to add regulations related to long-term mobile vending facilities and commissionaires.
The item returns to the planning commission after the Brentwood city council provided direction to staff related to the mobile vending ordinance at its February 27 meeting—there was then direction given to long-term mobile vending facilities.
Ultimately, by the March 12 meeting, the city council adopted its Sidewalk Vending Ordinance, but allowed the Mobile Vending Ordinance to be continued. Furthermore, the Land Use and Development Committee (LUD) provided direction on regulations.
The city is looking to establish a new approval process for Long-term mobile vending through a Temporary Use Permit (TUP) which would allow the city greater flexibility in approving, denying, and/or revoking permits. Major TUPs are reserved for larger events or applications, while minor TUPs are considered more routine in nature.
Note – “Long-term mobile vending facilities” are defined as those that operate on a long-term, not short-term basis, that are allowed by the underlying non-residential zoning district, are an ancillary use to a primary use on the property, and comply with all the requirements contained in Title 17 (Zoning) of the Brentwood Municipal Code
According to the staff report, LUD has recommended that the following general parameters for long-term mobile vending zoning regulations be included in revisions to Chapter 17.850.
- Setbacks. Long-term mobile vending facilities would be required to be located at least five feet from the edge of any driveway or public sidewalk, utility boxes and vaults, handicapped ramp, building entrance, exit or emergency access/exit way, or emergency call box and be located a minimum distance of 15 feet in all directions of a fire hydrant.
- Parking requirements. Long-term mobile vending facilities would only be permitted to be parked in a designated parking space(s) on a paved surface outside any designated fire lane. The mobile vending facility and associated seating, if any, should also be located outside any parking or loading space that is required to fulfill the minimum parking requirements for the principal use on the property, during the principal use’s hours of operation.
- Seating requirements. All associated tables, seating, and/or shade structures be removed at the end of each business day and not be permanently erected outside of business operations. In addition, all associated furnishings should be maintained in a clean manner such that it does not create an unsightly appearance.
- Electric outlet hookups are required to be installed for long-term mobile vending facilities and must be used while the mobile vending facility is on the premises. No generators shall be utilized on-site. If extension cords, hoses or other utilities are required, they shall be safety secured and not impede any path of travel.
- Accessibility Requirements. Long-term mobile vending facilities must operate in a manner and have access to restrooms consistent with current California Building Code (CBC) standards, which shall be provided on site and located within a maximum of 50 feet from the proposed long-term mobile vending facility parking location, unless otherwise approved by the community development director. Restrooms shall be provided, at no charge, for customer use during normal business hours and shall be continuously maintained in a clean and sanitary manner.
The planning commission will also look at commissionaires.
These are a food facility that services mobile food facilities, mobile support units, or vending machines where any of the following occur: (1) food containers, or supplies are stored; (2) food is prepared or prepackaged for sale or service at other locations; (3) utensils are cleaned; or (4) liquid and solid wastes are disposed, or potable water is obtained. A commissary may be considered in a underlying non-residential zoning district, if the commissary is an ancillary use to a primary permitted use on the property, and complies with all the requirements contained in Title 17 (Zoning) of the Brentwood Municipal Code. Approval would be required in order to allow for a mobile vending facility to remain on-site overnight, when associated with an on-site commissary.
Staff is recommending the following general parameters for commissary and associated mobile vending facilities:
- All associated mobile vending facilities approved to be on the site of a commissary must be directly owned or operated by the commissary.
- Number of Mobile Vending Facilities per Commissary. No more than two mobile vending facilities may be approved through the Temporary Use Permit process for each commissary.
- Parking Requirements. The mobile vending facility associated with the commissary is only permitted to be parked in a designated parking space(s) on a paved surface outside any designated fire lane. The mobile vending facility and associated seating, if any, should also be located outside any parking or loading space that is required to fulfill the minimum parking requirements for the principal use on the property, during the principal use’s hours of operation.
- County Approval. Prior to operating, a commissary shall obtain a commissary permit issued by Contra Costa County, must be if applicable.

Athletic Edge Stunt/Tumble
Application for a Conditional Use Permit at 470 Harvest Park Dr. The project site is located within suites “G” & “H” of an existing office/light industrial building. The proposed STUNT/tumble facility is being considered as an indoor recreation use which is consistent with past practice by the City.
The site is located within subarea “C” of Planned Development 12, which does not explicitly permit indoor recreation uses. However, the use can be permitted per Section 17.462.003(7) of the Brentwood Municipal Code (BMC) which allows additional uses in subarea “C” with a Conditional Use Permit (CUP), and per the provisions of Section 17.450.004 which allows non-listed uses to be considered through a CUP process. – Staff Report
Boat Pros
They are seeking a 2,000 square foot maintenance/warranty service area within the existing Boat Pros dealer/showroom at 8130 Brentwood Blvd. The applicant requests approval of a Conditional Use Permit (CUP 24-004) to establish a 2,000 square foot maintenance/warranty service area within the existing 6,400 square foot Boat Pros show room/dealership located at 8130 Brentwood Boulevard. Retail uses as well as show rooms and dealerships are permitted uses within the COIR District. The proposed service area is dedicated solely to maintenance and warranty services that may include boat repair and testing as further described in the attached project description. The majority of the work done will be dedicated to warranty service of Bass Cat boats that are sold on site or from other dealers.
