Newsom Vetoes Bill Allowing Undocumented Immigrants Access to Down Payment Assistance for Home Loans

On Friday, Governor Gavin Newsom vetoed a bill that would have allowed undocumented immigrants access to apply for the first-time home buyer assistance program.

AB 1840 was introduced by state Assembly member Joaquin Arambula, D-Fresno, where it basically says a person who applies for the California Dream for All Program cannot be disqualified because of their immigration status.

Here is a look at the veto message:

To the Members of the California State Assembly:

I am returning Assembly Bill 1840 without my signature.

This bill seeks to prohibit the disqualification of applicants from one of California Housing Finance Agency’s (CalHFA) home purchase assistance programs based solely on their immigration status.

Given the finite funding available for CalHFA programs, expanding program eligibility must be carefully considered within the broader context of the annual state budget to ensure we manage our resources effectively.

For this reason, I am unable to sign this bill.

California Assembly Republican Leader James Gallagher who previously called the bill “crazy” released the following statement after the veto.

“The Democrat’s legislation to give illegal immigrants access to taxpayer-funded down payments for homes (up to $150,000!) has been vetoed. Why? Because the media, the public, and Assembly Republicans exposed this crazy idea. Thank you to everyone who weighed in,” said Gallagher.

Under Assembly bill 1840, it grants undocumented immigrants access to the California taxpayer-funded home loan program – which provides up to $150k in down payment assistance for eligible first-time home buyers (those who pay taxes).

The bill, basically says a person who applies for the California Dream for All Program cannot be disqualified because of their immigration status.  AB 1840 was introduced by state Assembly member Joaquin Arambula, D-Fresno

  • August 28 – Passed Assembly Floor in 53-18 vote (locally, Assemblymembers Tim Grayson, Rebecca Bauer-Kahan, Buffy Wicks voted for the bill)
  • August 27 – Passed Senate Floor in 25-14 vote (locally, Senator Steve Glazer voted against the bill)

Mr. Newsom’s veto message is carefully worded to include only fiscal reasons but you can bet its a political gesture as he attempts to tack toward the political center.
