Contra Costa Law Enforcement Issues Statement on Immigration Enforcement

Over the past 48-hours, local police agencies in East Contra Costa County issued statements regarding immigration enforcement in California.

The Antioch Police Department, Brentwood Police Department and Pittsburg Police Department all released statements saying they do not participate in ICE Raids or federal immigration enforcement. They also said they do not ask individuals about their immigration status for enforcement purposes.

At the January 21 Contra Costa County Board of Supervisors meeting, Contra Costa County Sheriff David Livington shared how they will notify ICE noting 577 notification requests were made, however 131 notifications were made.

“The reality is the number of requests we receive from ICE are shown in the presentation, but the actual number of notifications that we make are significant less,” explained Livingston. “We follow the law here in California, which was known as SB54 which limits our interaction with any official regarding immigration. These are only violent and serious offenders to be released that we do notify ICE about, all the other requests we do not comply.”

Livingston said ICE does not come into the facility, not allowed to do interviews. He also said he didn’t see many changes with their role with ICE or state law due to new administration but did see an acceleration from federal government but since they do not house ICE detainees they should not be impacted.

Upon further questions, Livingston confirmed he would continue to follow state law.

Here are the statements released by the police departments.

On January 24, Mt. Diablo Unified School District Superintendent Dr. Adam Clark sent a message to District staff, parents/guardians and students highlighting  that safety and well-being of our students remain their top priority. He added every child deserves to learn in an environment free from harm, harassment, and fear, where they can focus on their academic, social, and emotional growth. Our District is deeply committed to ensuring that all students are protected, respected, and supported—regardless of their background, race, religion, immigration status, gender, or socioeconomic status.

The letter also included Board Policy: “Unless authorized by the Family Educational Rights and Privacy Act pursuant to 20 USC 1232g, student information shall not be disclosed to immigration law enforcement authorities without parental consent, a court order, or judicial subpoena.”

In Southern California, the Los Angeles School Police Department issued a statement saying, they follow policy and said, “We follow District policy and comply with state and federal laws related to the confidentiality of student records. We do not assist or engage in immigration compliance checks, immigration enforcement activities, or ICE-related task force operations.”

No other information was released by the City of Antioch, City of Brentwood or City of Pittsburg.

  3. Access to Services: Everyone in our community should be able to access essential services, including healthcare. Recent federal actions will not affect how the County provides these services.

We recognize that fear and uncertainty can prevent people from seeking County programs and services, but we want to assure you that our services are here for you. You have the right to feel safe and secure in your community, and our longstanding policies are designed to uphold your safety and trust.
