On Tuesday, the Brentwood City Council will hear an appeal by One Stop Smoke Shop regarding its Tobacco Retail License Suspension.
The suspension stems from a Brentwood Police Department decoy operation on March 20, 2026 where an individual under 21 but over 18 entered the smoke shop and purchased cigarettes by an employee without the employee asking for identifiecation – a violation of BMC 5.76.040 (D).
An Administrative Citation (attached) and notice of 60-day suspension and fine of $1,000.00 were issued per BMC §5.76.170(A)(1). Appeal information was provided to the business owner with the Administrative Citation, and a timely appeal (attached) was filed with the City Clerk on March 30, 2026.
Per the city of Brentwood, The owner of One Stop Smoke Shop attached a letter to the appeal stating that a temporary employee was managing the store on March 20, 2026, and the employee was instructed not to sell tobacco products to anyone under the age of 21.
According to the letter (see blow) submitted by Noman Yousifi, owner of the smoke shop, he had been operating the business for the past 4-years and has a strong commitment to complying with all tobacco-related laws and regulations while also stating they have passed several inspections conducted by the city and county.
Per the letter, “The violation occurred on March 20, 2026, which was the first day of Eid ul-Fitr, a significant religious holiday. On that day, I asked a temporary employee to manage the store so I could observe the holiday with my family. I clearly instructed the employee not to sell tobacco products to anyone under the age of 21.”
Yousifi called it an “isolated mistake” and the incident did not represent his business practices while making several corrective actions, including enhanced staff training, stricter ID verification, and stronger supervision policies.
According to the staff report, One Stop Smoke Shop, located at 2411 Empire Ave., was issued a License and a 12-month Wind Down Permit on October 9, 2025. Under the new municipal code, retailers with this license, would be subject to at least two compliance checks and the police department would perform at least one decoy operation on each Tobacco Retailer per 12-month period.
