Brentwood Planning Commission to Talk Eight Acres, County Admin Building

by CC News

On Tuesday, the Brentwood Planning Commission is set to hold its one-year review Conditional Use Permit of Eight Acres Kitchen & Bar.

The annual review was unprecedented after Commissioner Rod Flohr asked for a one-year review be included after Sean McCauley turned the former Deer Ridge Club House into a restaurant (Eight Acres)

According to the staff report, to ensure that the required review is comprehensive, staff checked with each department to see if there have been any issues since Eight Acres Kitchen & Bar opened last August. The Police Department indicated that there have been two noise complaints made by residents in the vicinity, both related to music coming from the facility in the evening.

The first complaint was received on Thursday May 14, 2026, at 8:22 p.m. and the second complaint was received on Thursday June 4, 2026, at 9:10 p.m.

Both were resolved, as upon response no music was found to be playing, and the incidents were closed.

One other issue has been identified related to lighting, both from the parking lot as well as the outdoor area behind the building. Complaints have been received periodically from a resident that lives on Spyglass Drive and whose rear yard looks out across the former golf course and towards the facility. The property in question is located approximately 525 feet from the facility’s closest property line and approximately 850 feet to the outdoor area behind the building — it should be noted that the parking lot lights are the same ones that have been in place on the project site since the Deer Ridge Clubhouse opened in the early 2000s. Staff recommends that a condition of approval be added to confirm that lighting must be shut off by 11:00 p.m.

Request to Extend Hours for Music

Currently, music and live events are limited to 9:00 pm. Special event are limited to Fridays, Saturdays, and Holidays only – outdoor special events also are limited to four times per month and shall be confined to existing patio and lawn areas and music only played until 9:00 pm.

The property owner is requesting that the hours for the playing of music be extended to 10:00 p.m. since the City’s noise ordinance (Chapter 9.32 [Noise Regulations] of Title 9 [Public Peace and Welfare]) since it would not violate the interior or exterior noise levels permitted for nighttime noise. While there have been two complaints about noise coming from the facility, staff recognizes the importance of the property owner’s request in terms of value to the business. Staff therefore proposes the modified conditions in the attached draft resolution. Adoption of these modified conditions are entirely discretionary on the part of the Planning Commission, so if concerns about extending the time to 10:00 p.m. are significant, the conditions can be left as they are currently written.

Background:

General Plan conformance review for the East County Service Center project

Also on the agenda is the East County Service Center project. The commission is being asked to Adopt Resolution No. 26-013 finding the East County Service Center project, including Contra Costa County’s recent acquisition of a 5.06-acre parcel to include within the scope of the project, does not substantially conform to the General Plan.

The primary areas of concern regarding General Plan conformance that were identified by the Planning Commission related to circulation, land use, and noise. Specifically, the Planning Commission noted that the project did not conform to the General Plan for the following reasons:

  • Inconsistency with Action LU 3b: “Concentrate major office uses along State Route 4 near the Lone Tree Way, Balfour Road, and Marsh Creek Road interchanges.” The project would be a regional facility and a major office use that should be near State Route 4.
  •  Inconsistency with Policy SA 3-5, which requires the City to ensure that all areas are accessible to emergency response providers. The building is proposed to be 50 feet tall and there is inadequate evidence in the record to demonstrate appropriate fire apparatus availability.
  • Inconsistency with Policy LU I-4, which requires new development to occur in a logical and orderly manner focusing growth on infill locations. This project proposes a regional facility in mostly undeveloped area.
  • Inconsistency with Policy LU 1-5, which encourages new development to be contiguous to existing development. This project proposes a regional facility in a mostly undeveloped area.
  • Inconsistency with Policy LU 3-5, which requires the City to actively promote the Brentwood Boulevard Specific Plan. The Brentwood Boulevard Specific Plan’s COIR zoning designation assumes that 70% of the area will be High Density Residential uses, and this project does not propose any residential uses.
