On Tuesday, Antioch City Attorney Thomas Lloyd Smith is set to get a raise as this will be the fifth amendment to his employment agreement. He will receive a 6% raise and now earn $259,145.
Although the Antioch City Council has placed Smith’s Performance Evaluation on its agenda 9-times in the past year, Smith apparently earned “exceeds expectations” during his review.
The staff report fails to provide any information on how Smith ‘exceeds expectations” or provides any of his achievements in policy he helped craft — or how much legal work is kept in house versus contracted out–including a $38k payment for a contract the city said was deemed “invalid” under then city manager Cornelius Johnson.
The Fifth Amendment will reflect direction provided to the Human Resources Director on August 25, 2023, in closed session following the evaluation of Thomas Lloyd Smith’s performance to increase the annual salary by 6% beginning March 1, 2023.
Smith was hired back in 2019 with a salary of $195,000.
According to the staff report, the fiscal year 2024 General Fund fiscal impact is $7,438 expected to be covered by the vacancy in the Assistant City Attorney positions. The fiscal year 2025 General Fund fiscal impact is $7,758 which will require a budget adjustment—if you recall, in June, the assistant city attorney informed the Antioch City Council during a council meeting it would be her last meeting and was leaving the city, see video and a shocked city council.
Smith was hired in February of 2019 while he was an attorney with Meyers Nave Riback Silver & Wilson.
While working as an Attorney for Meyer Nave, Smith has been assigned to the City of San Leandro as Assistant City Attorney and has provided legal counsel to the City of El Cerrito, City of Larkspur, and Central Contra Costa Sanitary District. While working for Garcia Hernandez Sawhney, Mr. Smith supported a City, a Special District and several Community College entities. His earlier legal experiences were with two Boston based law firms where he supported public policy issues and provided advisory services for non-profits, star-ups and venture capitalists. Mr. Smith has extensive experience in public law, contract law, conflicts of interest, workplace investigations, employee discipline and DFEH/EEOC matters. He has dealt with issues of the Political Reform Act, Ralph M. Brown Act and the Public Records Act.
Prior to his legal experience, Mr. Smith worked for three years as an Administrative Manager for a global law firm where he oversaw four departments with responsibility for business planning and the profit and loss statement. Mr. Smith also founded and was Executive Director for a Boston based Charter School geared towards grades 6 – 8. He started his professional career as a business analyst for McKinsey & Company in New York.
