Bay Point Woman Arrested for Allegedly Threatening Berkeley Mom, 5-year-old with Gun

The Berkeley Police Department reports that on November 29th, detectives arrested Tiffany Payne, 41 of Bay Point, in connection with a shooting that occurred at a Strawberry Creek Park neighborhood in August.

On August 29th at 3:53 pm, the suspect approached a 5-year-old boy on the 2200 block of Bonar Street and started bothering him.  When the child’s mother confronted the suspect, the suspect pulled out a handgun and pointed it at the mother’s head.  The suspect then shot the gun in the air and threatened that she could shoot the mother too.

This shooting took place in a driveway between two apartment buildings which border Strawberry Creek.  At the time of the shooting, there were multiple children present that could have been harmed by the gunfire.

After the speaking with witnesses and reviewing security footage from the area, investigators identified the suspect as a 41-year-old woman from Bay Point, CA.  Detectives then obtained a warrant for the suspect’s arrest.

On November 29th, detectives arrested the suspect during a search warrant of her Bay Point residence—where they also recovered a loaded handgun that had previously been stolen during a robbery in Oakland.

On November 30th, the Alameda County District Attorney’s Office charged the suspect with PC 422(a)—criminal threats, PC 246.3—unlawfully discharging a firearm in a negligent manner, PC 273a(a)—willfully causing a child to suffer, and PC 12022.5(a)—criminal enhancement for using a firearm in the commission of a felony.
