Pleasant Hill to Talk ADU and Wireless Telecommunication Ordinance Amendments

The Pleasant Hill Planning Commission will be hosting two upcoming meetings where they tackle  series of proposed ordinances.

  • Aug 7 -Miscellaneous Zoning Ordinance Amendments
  • Aug 12 – ADU and Wireless Telecommunication Ordinance Amendments

The Planning Commission will  consider a recommendation to the City Council concerning two separate proposed zoning ordinance amendments related to Accessory Dwelling Units (ADU) (Section 18.20.095) and Wireless Telecommunications Facilities (Section 18.67).

The proposed amendment to the ADU ordinance would modify provisions that were implemented as part of an urgency ordinance in response to State Legislation that was passed in 2022.

The proposed amendments to the Wireless Telecommunications Ordinance would insure compliance with recent updates to State law. The Commission will review the proposed amendments and make a recommendation to the City Council.

Pursuant to Section 15061(b)(3) of the Guidelines for the Implementation of the California Environmental Quality Act (CEQA) of 1970, as amended, the lead agency has determined that the proposed activity is exempt from CEQA. The City, as the lead agency, has determined with certainty that the proposed activity will not have a significant effect on the environment, as the proposed amendments are intended to comply with State law and have an ordinance consistent with State mandated provisions.  In addition, under California Public Resources Code section 21080. 17, the California Environmental Quality Act (“CEQA”) does not apply to the adoption of an ordinance by a city or county implementing the provisions of section 65852.2 of the Government Code, which is California’s ADU law and which also regulates JADUs as defined by section 65852.22. Therefore, the proposed ADU ordinance is statutorily exempt from CEQA in that the proposed ordinance implements the State’s ADU law

The PUBLIC HEARING will be held by the PLANNING COMMISSION starting at 6:30 p.m. on TUESDAY, AUGUST 22, 2023, in the CITY COUNCIL CHAMBERS, City Hall, at 100 Gregory Lane, Pleasant Hill and through Video/Teleconference via Zoom Conference Meetings. Interested persons, both in-person and those participating through Zoom, will be heard at this time at the meeting. More information on how to participate via zoom, including providing live comments during the meeting, will be provided on the posted Planning Commission Agenda.

The public hearing  will be held by the City Council starting at 7:00 p.m. on MONDAY, AUGUST 7, 2023, in the CITY COUNCIL CHAMBERS, City Hall, at 100 Gregory Lane, Pleasant Hill and through Video/Teleconference via Zoom Conference Meetings. Interested persons, both in-person and those participating through Zoom, will be heard at this time at the meeting. Notice is also given pursuant to Government Code Section 65009(B) that, if this matter is subsequently challenged in Court by you or others, you may be limited to raising only those issues you or someone else has raised at a Public Hearing described in this notice or in written correspondence delivered to the City of Pleasant Hill at, or prior to, the Public Hearing.
