Over the weekend, another Contra Costa District Attorney report was posted online which released more text messages by Antioch Police Officers.
UPDATE: Statement from DA DA’s Office Releases Second Redacted Investigative Report
Martinez, California — The Contra Costa District Attorney’s Office has made a second investigative report available to the public. Like the previous report, this one also details texts and images sent and received by certain members of the Antioch Police Department in March 2021.
On April 7, 2023, the court ordered the DA’s Office to disclose redacted investigative reports to defense attorneys representing clients in a felony criminal case. The judge issuing the order reminded defense counsel about the sensitive nature of the content of the reports and urged caution in its distribution beyond the parties involved in the criminal case.
The District Attorney’s Office agreed with the court advisory — as the documents contained explicit words and images that are hurtful, offensive, and inflammatory.
Media interest in accessing the second report increased over the weekend when a copy of it was leaked to the press and public by an individual or group outside of the DA’s Office.
Like the 21-page report that the DA’s Office made available on April 13, 2023, a redacted copy of a 14-page investigative report is available to view. The DA’s Office added further redactions to balance public interest with the sensitive nature of what is contained in the report.
The 14-page report focuses on two suspects, Terryon Deshon Push and Trent Allen. It involves multiple Antioch Police Officers and a US Postal Inspector. The officers include:
- Sgt. Josh Evans
- Officer Jonathan Adams
- Officer Scott Duggar
- Det. Robert Gerber
- Officer Tom Smith
- Officer Brock Marcotte
- Officer Timothy Manly Williams
- Officer Eric Rombough
According to the report, it states it found text communications between sworn law enforcement members of the Antioch Police Department who may have violated the Racial Justice Act.
This report documents some of the derogatory, homophobic, and sexually explicit language and photographs shared by memes of the Antioch Poles Department that demonstrates their racial bias and animus towards African Americans and other people of color in the community. This report does not include every derogatory text message received during our review of the above listed cellular telephones. This an ongoing state and federal criminal investigation which may lead to further disclosures. This report also documents potential dishonesty, perjury, abuse of authority and the violation of individual civil rights.

Who is Investigator Larry Wallace?
Larry Wallace had accusations of harassment surface from the time that he was working for her at the California Department of Justice. Wallace resigned after the The Sacramento Bee inquired about a $400,000 harassment and retaliation settlement from his time working for Kamala Harris when she was attorney general of California. At the time of the alleged harassment, Wallace was working as the director of the Division of Law Enforcement. The lawsuit was settled by the Department of Justice in May 2017 after Xavier Becerra had assumed the role of attorney general.

It is unclear if Wallace was the person in the District Attorney’s Office who opted not to move forward after Antioch Police brought forward information that revealed Antioch Mayor Lamar Thorpe and City Clerk Ellie Householder Engaged in Possible Criminal Conduct. The Share Order did not provide any examples of the communications or screen shots, but stated the data range was between Dec. 1, 2020 through January 15, 2021 which included all communications, social media, images, videos locations, web history from Shagoofa Khans phone..
