Brentwood Council to Talk Back Yard Rental Ban After Shootout

On Tuesday, the Brentwood City Council will discuss amending its municipal code regarding back yard rentals and regulate parties in residential zones.

This will be the first step towards a potential ban, but first, the council has to agree to bring the item back and allow staff to work on an ordinance.

The item is in response to a recent party at a home which resulted in a gunfight which left one person dead on July 14. The item falls under future agenda items so the council will decide if they want to direct staff to work on an amendment.

“The peaceful quality of life of our neighborhoods is of utmost importance to the City, and we will continue to enforce our existing codes taking essential steps to maintain to preserve the harmonious living environment of our residents,” said Tim Ogden, City Manager.

Call for review of the Planning Commission’s decision to approve applications for Vesting Tentative Subdivision Map and Design Review for Trumark Trailside

This item was previously approved by the Planning Commission in a 4-1 vote on June 20. The approval was for the Vesting Tentative Subdivision Map and Design. On June 29, 2023, Council Member Jovita Mendoza filed a timely call for review.

Trumark Homes is requesting a vesting tentative subdivision map (VTSM 9610) to create 63 single-family residential lots, one bio-retention basin, one open space lot adjacent to Sand Creek, and other related improvements. The project also includes a design review (DR 22-006) for the homes to be constructed on the 63 lots (including 57 single-family detached homes and six affordable duets). The duet units would have an average lot size of 4,188 square feet and the remaining 57 residential lots would range from 8,000 to 13,674 square feet in size, with the exception of one larger estate lot located along the eastern edge of the site (adjacent to the existing Ranchette Estate-zoned lots) that would be 30,000 square feet in size.

The project includes six affordable units; two reserved for very low-income households, two reserved for low-income households, and two reserved for moderate-income households. The applicant is not proposing to utilize the State Density Bonus law, and is complying with the City’s density transition and mid-point policies as outlined in the General Plan.

The applicant has indicated that they are supportive of the Planning Commission’s request to make changes in the four identified areas as modified in condition #11 including clarifying the plans to reflect that all roofs will be tile and are now awaiting the City Council call for review before moving forward.

Continuance of a public hearing for the consideration of ordinances enacting a permanent ban on all oil and gas development operations in the City, and more stringent regulatory control measures for existing oil and gas development in the City.

On August 3, 2023, the day that the August 8, 2023 City Council agenda was published, the California Supreme Court issued a decision in Chevron. As the case involves a ban on the drilling of new oil and gas wells, staff and the City’s legal counsel need time to analyze it and determine the decision’s impact on the proposed ordinances. It is therefore requested that the City Council continue the public hearing to September 12, 2023.

July 31: Brentwood to Take Action to Preserve Residential Neighborhoods

BRENTWOOD, CA –  The City of Brentwood is committed to maintaining the safety and tranquility of its residential neighborhoods.

Recently a homicide occurred near a residential home that was allegedly rented out for a party, which is not allowed by the City’s municipal code.  The allegation is currently being investigated, as well as the criminal investigation into the homicide.  Our sympathies go out to those impacted by the violence of this tragic incident.

Due to concerns expressed at the July 25, 2023 City Council meeting, a future agenda item will be considered to update the City’s municipal code related to non-permitted party rental and noise activities in residential neighborhoods. — see story

July 27: Brentwood Residents Speak Out After Deadly Shootout

On Tuesday, several Brentwood residents spoke out over public safety concerns after a recent robbery attempt turned shootout that left one person dead in a shootout. Residents called for an ordinance and more protections against for-profit parties in residential neighborhoods after a July 14 robbery attempt turned into a shootout that left one juvenile dead, another wounded. On Tuesday, Brentwood Police say they had 12 calls for service to the Marjoram Drive neighborhood since 2022 and staff said they already have an ordinance that does not permit for-profit parties in backyards.

Still, several residents urged the council to take action now that they are aware of a disconnect between residents and Brentwood city staff and wanted the Brentwood police to do more to prevent these activities. — See Full Story

“This will be the first step towards a potential ban” like the ban on guns you folks have, you dummies even have to show identification to buy ammo, it’s just starting.
