AB 2930: Bill to Eliminate Bias in AI Decision-making Passes Privacy Committee

Sacramento, CA – Assemblymember Rebecca Bauer-Kahan’s (D-Orinda) groundbreaking artificial intelligence regulation, AB 2930, passed its first policy committee with a vote of 8 to 3. AB 2930 requires developers and users of AI tools to mitigate bias in automated decision tools (ADTs) that make consequential decisions.

“Bias is embedded in the decisions made about our lives. The difference with AI is that it’s completely opaque. Without regulation, these tools can reinforce inequality without our knowledge,” said Assemblymember Bauer-Kahan.” AB 2930 continues our work to ensure that AI fulfils its promises of progress and does not drag us backwards with biased results.”

Automated decision tools are being used to assess eligibility for a benefit or penalty. These systems have been traditionally used for credit decisions, however usage has expanded to employment screening, insurance eligibility, and health care decisions. ADTs have been found to exhibit biases and consequently have resulted in discriminatory impacts and harm to marginalized communities. For example, a study published in Science showed that a clinical algorithm used across hospitals for determining patient care was racially biased against Black patients.

AB 2930 requires developers and users of ADTs to conduct and record an impact assessment including the intended use, the makeup of the data, and the rigor of the statistical analysis. The data reported must also include an analysis of potential adverse impact on the basis of race, color, ethnicity, sex, religion, age, national origin, or any other classification protected by state law.

In addition to AB 2930, Assemblymember Bauer-Kahan’s AB 1836 limiting digital replications of artists and performers, and AB 2885 which creates a definition of AI, all passed the Assembly Privacy and Consumer Protection Committee.
