Walnut Creek to Talk Chick-Fil-A Restaurant

At its upcoming May 21 meeting, the Walnut Creek City Council will hear an appeal for a conditional use permit by Chick-Fil-A.

The applicant is seeking Planning Commission approval of a 5,363 square foot Chick Fil-A restaurant building proposed at the corner of Oak Grove Road and Citrus Avenue, replacing the existing (former bank) building — located within the Citrus Marketplace Shopping Center. The restaurant will offer dine-in and take-out services only. No drive-thru window is proposed. The project also includes tree removals, modifications to the site layout, new landscaping and building signage.

On March 14, the Planning Commission approved the CUP and also approved a Tree Removal Permit and determined the parking on site was adequate for the proposed use.

However, the item is being appealed. On March 25, Corban Porter and Friends of Walnut Creek (the latter appearing to be a group of neighboring residents but of unknown size and number), (collectively, “Appellant”) timely filed an appeal of the Planning Commission’s decision by stating that the proposed restaurant would be detrimental to the health, safety and welfare of the community due to the concerns related to traffic, pick-up/take-out food deliveries, nuisance, and the proposed hours of operation.

According to the appellant, concerns include:

• Traffic and Safety Concerns
• Other Delivery Services (Door Dash, Uber Eats, etc.) Serving as Proxy Drive-Thru.
• Nuisance Concerns
• Hours of Operation

Staff provided a detailed response to each alleged complaint.

According to the staff report, staff recommends the City Council deny the appeal and adopt the resolution upholding the Planning Commission’s decision of the Project subject to conditions of approval contained in the draft resolution.
